GENERAL TERMS AND CONDITIONS (effective from 1 February 2024) WAN Tanácsadó Bt. (hereinafter: Seller) markets jewelry designed and produced by it under the brand name Vadjutka. This document contains the general terms and conditions for the use of the website operated by the Seller at www.vadjutka.com (hereinafter: Website) and its online store (hereinafter: Webshop), as well as the details of the legal relationship between WAN Tanácsadó Bt. and the customers in the course of sales conducted through these platforms. By placing an order on the Website, a contract is concluded between the Seller and the customer (hereinafter: Buyer). The contract thus created qualifies as an electronically concluded contract, which is archived as a non-signed written contract, retrievable and reviewable afterwards. The Webshop only concludes contracts with adults; in the case of an order placed by a minor, the contract shall be deemed invalid.

2. Products

The Seller designs and manufactures unique, handcrafted jewelry and accessories. The products available at any given time are displayed on the Website. The Seller strives to provide detailed descriptions and high-quality photos of the products, but minor variations in color, proportions, or patterns may occur, for which the Seller assumes no liability. Buyers may also order custom-made jewelry not listed in the current selection. Further information can be found below under the heading “Ordering Custom Jewelry.”

3. Registration

All content on the Website is accessible to anyone without registration. Registration is not a prerequisite for purchasing in the Webshop, but it is recommended as it simplifies future purchases. Registration is quick and requires only the essential information needed for fulfilling the order. Registration can be completed on the Website at: XXXXXXXXX  by filling in the provided form. Mandatory information for registration:

• Last name
• First name
• Postal address
• Email address
• Phone number (preferably mobile)
• Password
• Password confirmation

The Buyer bears full responsibility for any damages or delays resulting from incorrect, incomplete, or inaccurate data provided during registration (e.g., additional postage costs). By registering, the Buyer undertakes to update their data as necessary to keep it accurate and up to date. Forgotten passwords can be reset using the “Forgot password” function. The Seller treats all personal data confidentially in compliance with data protection laws and does not disclose it to third parties. Registration requires the acceptance of these Terms and Conditions. The Buyer may request deletion of their registration at any time by sending an email to hello@vadjutka.hu. If the Buyer wishes to order again in the future, a new registration will be required.

4. Purchasing Process

Selected products can be added to the Cart with a single click. Adding products to the Cart does not oblige the Buyer to purchase them. Before finalizing the purchase, any item can be removed from the Cart. After adding products to the Cart, the Buyer may continue browsing by clicking “Continue shopping” or proceed to checkout by clicking “View Cart.” At this point, the Buyer may choose to purchase as a “Guest” or register. Registered Buyers can log in with their password. Since the registration form already contains the Buyer’s personal and shipping details, only the shipping and payment methods need to be selected after logging in. Shipping methods:

• Courier delivery (FEDEX courier service)
• Personal collection (available only in Budapest, Hungary)

Payment methods:

• Online card payment (Barion)

After selecting the shipping and payment methods, the Buyer reviews the order summary, including items, quantities, total price, and shipping cost. Once verified, the Buyer places the order by clicking “Submit Order.” By submitting the order, the Buyer undertakes to pay for the selected products. Failure to pay may result in sanctions. The Seller is not responsible for technical issues during the purchasing process. An automatic confirmation email is sent to confirm receipt of the order. With this confirmation, a valid contract is established between Seller and Buyer, and subsequent modifications to the order (items and prices) are not possible. If no confirmation is received within 24 hours, the Buyer should contact the Seller by phone or email. Possible reasons for missing confirmation include incorrect email address, full inbox, or technical error.

5. Prices

All product prices shown on the Website are gross prices, including VAT, but excluding shipping costs. 5.1 Discounts The Seller may issue discount coupons valid for a percentage or a fixed amount reduction. Each coupon specifies the discount, the validity period, and the required code. If the Buyer uses a coupon within its validity period and enters the correct code, the discount will be applied, and the purchase will be completed at the reduced price. In such cases, the contract is concluded at the discounted price.

6. Payment

Online card payment Card payments are processed through the Barion system. The Seller does not have access to card data. The service provider is Barion Payment Zrt., supervised by the Hungarian National Bank, license number: H-EN-I-1064/2013. Orders will only be shipped once payment is received. Shipping costs must also be prepaid. 6.2 Personal Collection Products can be collected at the Seller’s registered office (see: “Store Locator” section). No shipping fee applies.

7. Delivery

Orders are shipped via FEDEX courier. Products are shipped in protective packaging and include one complimentary gift box per order. Delivery time is 5–20 business days, depending on the product. The Seller guarantees only the dispatch deadline, not the courier’s delivery time or lost shipments. The Buyer is responsible for checking the package upon receipt and reporting any damage immediately by having a report issued with the courier. Later complaints will only be accepted with an official report.

8. Right of Withdrawal

According to Hungarian government regulations, the Buyer has the right to withdraw from the purchase within 8 business days after receipt of the product, without justification. Withdrawal can be communicated via email, or in person in case of personal collection. The Buyer must return the product in original, non damaged condition in protective packaging, by registered mail, including the invoice. Return shipping costs are borne by the Buyer. The Seller undertakes to refund the purchase price (including any paid shipping fee) within 30 days of withdrawal. However, the Seller may claim compensation for damages resulting from improper use of the product. Withdrawal does not apply to custom-made products created specifically at the Buyer’s request.

9. Warranty

The Seller ensures that products are made to the highest possible standard and provides accurate descriptions on the Website. In the case of defective products, the Seller undertakes to replace them within 8 days. Not considered warranty issues:

• Natural oxidation of metals (tarnishing)
• Soiling of textiles
• Wear caused by improper use or storage

In cases of improper use or deliberate damage, the Seller is not obliged to replace or refund the product. Products that arrive damaged or broken during delivery will be replaced immediately upon notification, free of charge. In case of damage, the package (the packaging in its original condition and the product as well) must be kept and the report must be made within 3 working days of receipt. The notification can be made by email, at the email address hello@vadjutka.hu, indicating the order number, the name and number of damaged or broken products, and photos of the damaged products. The courier service can investigate the circumstances of the breakage, so pictures of the damage and the packaging help the work, but we may also need a damage inspection for a full investigation. The notification must be made within three working days after receipt, if no damage report was prepared upon receipt. All damage complaints will be dealt with as quickly as possible and damaged products will be re-shipped free of charge.

11. Data Protection

The Seller treats all data provided during registration or ordering confidentially and does not disclose it to third parties, except for data required for delivery.

12. Copyright

The Website is protected by copyright. All products, photos, and content displayed on the Website are the intellectual property of the Seller. Saving or printing for personal, non-commercial use is permitted. Any use beyond personal purposes (e.g., storing in a database, publishing, making available for download, or commercial use) requires the Seller’s prior written consent.

13. Custom Exclusive Jewelry Orders

The Buyer may request custom-made products via email or personal consultation. Custom orders require a 50% advance payment of the purchase price. Once completed, the Seller notifies the Buyer via email, and the remaining amount (plus any shipping costs) must be paid through the Webshop. Warranty applies to custom products as well, but the right of withdrawal does not.

14. Newsletter

In accordance with Hungarian advertising law, newsletters are only sent with the recipient’s prior explicit consent. Subscription can be completed electronically via the Website. The Buyer may withdraw consent at any time, without justification, and free of charge. In this case, the Seller will immediately delete all personal data from the newsletter database and stop sending newsletters.

15. Other Provisions

The Seller may unilaterally amend these Terms and Conditions at any time, notifying Buyers via a brief notice on the Website. Continued use of the Webshop constitutes acceptance of the amended Terms. For matters not covered in these Terms and Conditions, the provisions of the Hungarian Civil Code and Government Decree 17/1999 (II.5.) on contracts concluded between distant parties shall apply.
